This book develops a novel approach to distributive justice by building a theory based on a concept of desert. As a work of applied political theory, it presents a simple but powerful theoretical argument and a detailed proposal to eliminate unmerited inequality, poverty, and economic immobility, speaking to the underlying moral principles of both progressives who already support egalitarian measures and also conservatives who have previously rejected egalitarianism on the grounds of individual freedom, personal responsibility, hard work, or economic efficiency. By using an agnostic, flexible, data-driven approach to isolate luck and ultimately measure desert, this proposal makes equal opportunity initiatives both more accurate and effective as it adapts to a changing economy. It grants to each individual the freedom to genuinely choose their place in the distribution. It provides two policy variations that are perfectly economically efficient, and two others that are conditionally so. It straightforwardly aligns outcomes with widely shared, fundamental moral intuitions. Lastly, it demonstrates much of the above by modeling four policy variations using 40 years of survey data from the Panel Study of Income Dynamics. (shrink)

Frankfurt’s “Alternate Possibilities and Moral Responsibility” made an important intervention into the literature on moral responsibility via a classical Frankfurt-type example, arguing that “the principle of alternate possibilities” is false. This paper argues that classical Frankfurt-type examples fail due to the use of agentic counterfactual interventions who lack agency. Using finite state machines to illustrate, I show the models that classical Frankfurt-type examples must use and why they are incongruent with leeway incompatibilist beliefs—the motivating interlocutor for classical Frankfurt-type examples. I (...) then argue that returning agency to the agentic counterfactual intervention also returns alternate possibilities to the actual sequence of events, undermining a core premise of Frankfurt’s. Lastly, I show why a number of potential counterarguments should fail to persuade the leeway incompatibilist. (shrink)

On the State of Nature and On the Sovereignty of the People are Maistre's most comprehensive treatment of Rousseau's ideas and his most sustained critique of the ideological foundations of the revolution. On the State of Nature, a detailed critique of Rousseau's Discourse on the Origin and Foundations of Inequality, focuses on Rousseau's belief in the natural goodness of man; On the Sovereignty of the People, a critique of Social Contract, explores Rousseau's theory of popular sovereignty. In Maistre's eyes Rousseau (...) encouraged the socially destructive individualism that lay at the heart of the French Revolution. However, the essays reveal some surprising ambiguities in the relationship between two seminal thinkers who are usually thought of as polar opposites, suggesting that Maistre's vision was more akin to Rousseau's than he would have admitted. Against Rousseau offers valuable insights into the evolution of Maistre's counter-revolutionary ideas during the crucial years of 1792-97 and illustrates his remarkable insights into society and politics. Written and set on the banks of the Neva, St Petersburg Dialogues is a startlingly relevant analysis of the human prospect at the end of the twentieth century. As the literary critic George Steiner has remarked, "the age of the Gulag and of Auschwitz, of famine and ubiquitous torture,... nuclear threat, the ecological laying waste of our planet, the leap of endemic, possibly pandemic, illness out of the very matrix of libertarian progress" is exactly what Maistre foretold. In the Dialogues (...) Maistre addressed a number of topics which are discussed briefly or not at all in his other works already available in English. These include an apologetic for traditional Christian beliefs about providence, reflections on the social role of the public executioner and the "divinity" of war, a critique of John Locke's sensationalist psychology, meditations on prayer and sacrifice, and a mini-course on "illuminism." The literary form is that of the "philosophical conversation" -- one that allowed Maistre to be deliberately provocative and to indulge his taste for paradox, a "methodical extravagance" that he judged particularly appropriate for the eighteenth-century salon. Translator and editor Richard Lebrun provides a full scholarly edition of this classic work, complete with an introduction, chronology, critical bibliography, and generous explanatory notes. The Dialogues will be of interest to scholars of literary history as well as the history of ideas. (shrink)

Although often neglected, An Examination of the Philosophy of Bacon is crucial to understand the epistemological basis for Maistre's critique of modern science as well as his criticisms of other aspects of Enlightenment thought. Given Maistre's stature in the history of conservative thought, his critique of Bacon remains significant for what it tells us about Maistre's own thought, what it reveals about attitudes toward science in his time, and what it contributes to issues that are still debated today. The work (...) also showcases Maistre's polemical skills and his powerful prose style. Richard Lebrun's annotated translation includes Maistre's complete text, an extensive introduction that places the work in context and provides a critical exposition and assessment of Maistre's criticisms of Bacon, biographical notes on persons cited or mentioned by Maistre, and a bibliography. Differences between Maistre's manuscript and the printed text, first published fifteen years after the author's death, are noted, and Maistre's numerous citations have been identified, verified, and translated, making this the only authoritative and fully accurate edition of the work in either French or English. Paradoxically, the political success of human rights is often taken to be its philosophical failing. From US interventions to International NGOs to indigenous movements, human rights have found a place in diverse political spaces, while being applied to disparate goals and expressed in a range of practices. This heteronomy is vital to the global appeal of human rights, but for traditional moral and political philosophy it is something of a scandal. This paper is an attempt to understand and theorize human (...) rights on the terrain of the social actors who put them to use, particularly radical activists that have a more critical relationship to human rights. Attempting to avoid the philosophical pathology of demanding that the world reflect our conception of it, we base our reflection on the ambiguous, and potentially un-patterned, texture of human rights practice—taking seriously the idea that human rights express a relationship of power, importantly concerned with its legitimate arrangement and limitation. In both the philosophical literature and human rights activism, there seems to be a consensus on basic rights as undeniable moral principles of political legitimacy. This use of human rights is contrasted with radical social movements that reject this conception of rights as ideological and illegitimate, making specific reference to the Zapatista movement (Chiapas, Mexico) and the Landless Peasant Movement of Brazil (MST, from the Portuguese Movimento dos trabalhadores rurais Sem Terra), which are critical of the human rights discourse, but also make strategic use of the idea and offer alternative articulations of political legitimacy. Así en el primer ítem describimos los principales alertas emitidos a través de los Informes del IPCC (Intergovernmental Panel on Climate Change, o Panel Inter gubernamental sobre los Cambios Climáticos) destacando: a) la influencia y el papel de las actividades humanas en el proceso del calentamiento global y la (...) contaminación ambiental, y b) el costo de oportunidad de reducir las emisiones de CO2. En el segundo destacamos los principales inversionistas extranjeros interesados en la producción de los biocombustibles, colocando algunas reflexiones en relación a este negocio “lucrativamente sostenible”, y por último -a modo de consideración- enfatizamos la imposibilidad en relación a la creencia absoluta en el libre mercado como la mejor fuente de innovación y aprendizaje para desarrollar alternativas energéticas viables y sostenibles ambientalmente. L’Encyclopédie méthodique constitue une des entreprises éditoriales les plus imposantes publiées au tournant des Lumières. Conçue par l’éditeur Charles-Joseph Panckoucke, elle s’échelonne sur cinquante ans (1782- 1832). Elle remanie et reprend les volumes de l’Encyclopédie de Diderot et d’Alembert, en substituant à l’ordre alphabétique un ordre des matières. Elle oriente les Lumières vers l’épistémologie positiviste. C’est pourquoi cette encyclopédie, qui demeure pourtant souvent méconnue, revêt aujourd’hui un intérêt considérable, notamment parce qu’elle montre un moment particulier des savoirs qui relient (...) les mots et les choses. Les trois volumes du Dictionnaire d’Architecture, dus à la plume de Quatremère de Quincy, s’inscrivent dans ce cadre éditorial et culturel, et en même temps dans l’histoire longue des théories de l’architecture : ils achèvent une tradition qui remonte à Vitruve. Quatremère de Quincy reprend et corrige Vitruve quand la théorie de ce dernier est démentie par la raison ou par l’histoire. Mais derrière cette critique, Quatremère se bat aussi avec son siècle. En définissant l’architecture par les mots, il retrouve les exigences d’une définition de l’architecture « à l’antique », à savoir par et dans la langue. (shrink)

Since the introduction of the concept of brain death by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death in 1968, the validity of this concept has been challenged by medical scientists, as well as by legal, philosophical, and religious scholars. In light of increased criticism of the concept of brain death, Stephen Napier, a staff ethicist at the National Catholic Bioethics Center, set out to prove that the whole-brain death criterion serves as (...) good evidence for death in the Catholic bioethical framework, on the grounds that when whole-brain death has occurred the soul has already departed from the body. Opponents have argued that (1) brain death does not disrupt the somatic integrative unity and coordinated biological functioning of a living organism and (2) clinical tests outlined in the practice guidelines for determining brain death lack sufficient power to exclude persisting function and fail to detect elements of the brain that, although currently functionless, may retain potential for recovery under conditions of optimal medical care. It is therefore possible that heart-beating organ procurement from patients with impaired consciousness is de facto a concealed practice of active euthanasia and physician-assisted death, both of which, either concealed or overt, the Catholic Church opposes. _Strategies of Deconstruction _ was first published in 1991. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. In the past two decades, the "movement" of deconstruction has bad tremendous impact on a number of academic, disciplines in the United States. However, its force has been rather limited in the field of philosophy, despite the fact that in Europe the practice of deconstruction emerged in (...) the work of philosophers. Although the reasons for this can be debated, two of the more obvious explanations are the mainstream Anglo-American philosophers rarely studied the German and French philosophical traditions in great detail, and deconstruction's focus on discourse and interpretation has made it more attractive to the literary and humanistic disciplines. With this context, _Strategies of Deconstruction _ focuses on the early work of Jacques Derrida, the French philosopher who introduced deconstruction in _Speech and Phenomena_,his study of Edmund Husserl, and _Of Grammatology_, and whose philosophical reputation stems in no small part from his work on Husserl. In examining the philosophical import of Derrida's theories of reading, text, and language, specifically as they related to _Speech and Phenomena_,J. Claude Evans makes careful reference to Husserl's own texts. His analysis indicates that there are many systematic irregularities in Derrida's study and that without those irregularities Derrida's conclusions cannot be substantiated. (shrink)

This paper examines the nature of ‘reasonable’ argumentation in Generation of Animals III.10. Its aim is to develop an alternative to the dialectical construal of reasonable argumentation in Aristotle recently favoured by Robert Bolton. On the basis of a close textual analysis I show that the reasonable arguments deployed in Generation of Animals III.10 do not appeal to endoxa or reputable beliefs per se. Instead, they rely upon general facts about animals established by empirical induction. This implies that, contra Bolton, (...) not all reasonable arguments in Aristotle are dialectical; some, in fact, are thoroughly empirical and scientific. I conclude by suggesting that such empirical reasonable arguments even have a place in the De Caelo, the treatise that Bolton primarily focused upon when developing his interpretation. (shrink)

English-speaking readers might be surprised to learn that Alain Badiou writes fiction and plays along with his philosophical works and that they are just as important to understanding his larger intellectual project. In this paper, I examine Johannes de Silentio’s presentation of the faith of Abraham, deriving therefrom a new way of conceiving his notion of faith as a paradoxical co-inhabiting of both the aesthetic and the ethical stages, rather than as a rejection, synthesis, or overcoming of them. Relying largely upon Silentio’s account of Abraham’s faith as anxious but not doubting, I argue that the interpretations of Fear and Trembling by Alastair Hannay and Mark C. Taylor fail to account for some (...) essential aspects of Silentio’s depiction. I conclude that faith, as it is described in Fear and Trembling, cannot be philosophically understood as it is not an object for thought but an existential perspective one lives. (shrink)
